March 9, 2007 – Chagoya v. Standard Meat, Co.
Owen & Fazio partner Jerry Fazio and associate Jason Kipness won another victory for their non-subscriber client in the Dallas Court of Appeals. In August of 2006, a Dallas County trial court denied Standard Meat Co.’s Motion to Compel Arbitration. Standard Meat Co. sought a writ of mandamus. The Court of Appeals held that the Plaintiff signed a valid arbitration agreement, that this agreement was not procedurally or substantively unconscionable and ordered the trial court to rescind its previous Order and send the case to arbitration.

Congratulations to Jerry Fazio. Jerry has recently been named one of the “"Best Lawyers in Dallas"” in the area of personal injury law as voted on by his peers practicing in that area. This exclusive list will be published in the May 2007 edition of D Magazine and will feature Jerry's profile and picture.

February 9, 2007 – Jack In the Box, Inc. v. Skiles, – S.W.3d -, 2007 WL 431045 (Tex. 2007).
Owen & Fazio partner Jerry Fazio and associate Jason Kipness won an outstanding victory for their non-subscriber client in the Texas Supreme Court. On behalf of Jack In the Box, Inc., Jerry and Jason won a summary judgment against Mr. Skiles at the trial court level. However, this decision was overturned by the Court of Appeals. The Texas Supreme Court reversed the Court of Appeals and rendered a take-nothing judgment in favor of Jack In the Box, citing that Jack In the Box had no duty warn the Plaintiff of the a danger that is common and obvious to him.

Gregory A. Scott is now of counsel to Owen & Fazio, P.C. Mr. Scott was admitted to practice law in Texas in 1987. Mr. Scott is Board Certified in Civil Trial Law and Personal Injury Trial Law by the Texas Board of Legal Specialization. Mr. Scott practices insurance defense law specializing in arson, insurance fraud, and the defense of third party casualty claims.
